Justice system in Scotland

The Justice system in Scotland is administered through a series of agencies and departments by the Scottish Government.  These include the Scottish Court Service, the Crown Office and Procurator Fiscal Service and the Scottish Prison Service.  

Criminal Prosecution

The prosecution of crime in Scotland is the responsibility of the Crown Office and the Procurator Fiscal Service; these bodies are run by the Lord Advocate and the Solicitor General who are also non-elected members of the Scottish Government.
COPFS employs around 1650 staff, including about 400 lawyers, who every year deal with more than 290,000 reports on offences committed.

Scottish Court Service

The Scottish Court Service (SCS) is the Executive Agency which is responsible for the administration of the Court of Session, the High Court and the Sheriff Courts.
It employs over 1,000 people from Lerwick in the North to Stranraer in the South. It has no responsibility for District Courts which are managed by Local Authorities.

Children’s Panel

In Scotland children who have offended or who are considered to be at risk are referred to the children’s hearings system. This relies on the involvement of around 2,500 people from all walks of life, who give their time and commitment voluntarily to train and serve as children's panel members in their own local authority area.

At each hearing, panel members work with the child, parents or carers and professionals to make decisions which are in the best interests of the child. Every year around 600 new panel members are recruited.

The Scottish Prison Service

The Scottish Prison Service is responsible for running Scotland's 16 prisons and young offenders institutions. As well as Prison Officers and managerial staff, the service employs medical staff and administrators.
